Point of Sale (POS) Terms of Service

  1. Acceptance of Terms

By completing a purchase with Enchanted Creek Acres LLC, including purchases made at our farm, markets, events, or mobile point of sale systems, you agree to the following Terms of Service.

  1. Products & Availability

We offer a variety of farm-raised and produced goods, including but not limited to:

  • Pickled quail eggs (Grand Covey ™ brand)
  • Fresh quail eggs
  • Hatching eggs
  • Quail meat and value-added products
  • Live mature birds and chicks (when available)

All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time.

  1. Pricing – Retail/Wholesale

All prices are listed in U.S. dollars retail and are subject to change without notice. Applicable sales tax will be added where required by Texas law. Negotiations towards wholesale pricing must be conducted with senior management at Enchanted Creek Acres LLC and agree to prior to setting up the account. 

  1. Payment Terms

We accept the following forms of payment:

  • Cash
  • Credit/Debit Cards
  • Approved mobile payment platforms, CashApp, Venmo, Zelle, PayPal

Payment is due in full at the time of purchase. No items will be held without payment unless otherwise agreed in advance. On preorders, one half down at the time of purchase is required, completed transaction occurs balance due prior to shipping.

  1. Refunds & Returns

Due to the nature of our products, all sales are final.

Exceptions may be considered only in the following cases:

  • Product is damaged at the time of purchase
  • Incorrect items were provided

All concerns must be reported at the time of purchase or within 24 hours with proof of purchase.

  1. Live Animal & Hatching Egg Policy

All sales of live birds and hatching eggs are final. We do not guarantee hatch rates or outcomes due to factors beyond our control, including incubation practices and environmental conditions and the potential for damage that may occur during shipping. 

Our hatching or consumable eggs are carefully packaged in foam inserts and padded top and bottom. We ship with fragile warnings and clearly identifiable labeling on handling; UPS and/or USPS. Most orders are shipped within 48 hours. 

Customers assume full responsibility for the care and handling of live animals once purchased. We do not ship live mature birds or chicks. If in proximity of our farm, we can plan to meet or send them by courier and subject to delivery charges. 

  1. Food Safety Notice

Enchanted Creek Acres LLC follows proper handling and preparation standards. However, customers are responsible for:

  • Proper refrigeration and storage
  • Safe preparation and cooking practices
  • Purchased where allergy considerations aren’t respected

Products such as quail eggs and meat should be handled in accordance with standard food safety guidelines.

  1. Liability Disclaimer

Enchanted Creek Acres LLC is not liable for:

  • Improper storage or handling after purchase
  • Losses related to hatching eggs or live animals
  • Allergic reactions or food sensitivities
  • Misuse of products

All products are purchased and used at the customer’s own risk once they leave our possession.

  1. Order Accuracy

Customers are responsible for verifying their order before leaving the point of sale. We are not responsible for discrepancies not reported at the time of purchase.

  1. Chargebacks & Payment Disputes

Any payment disputes or chargebacks must first be addressed directly with Enchanted Creek Acres LLC. Fraudulent or unjustified chargebacks may result in refusal of future service.

  1. Privacy & Payment Security

All payments are processed securely through our point-of-sale provider. We do not store or retain sensitive payment information. We do not sell personal information to anyone. 

  1. Changes to Terms

We reserve the right to update these Terms of Service at any time. Continued purchases indicate acceptance of any updated terms.
